From Creative Approval to Consumer Consent: Preparing for CMS’s New Era of ACA Marketing Oversight

The CMS ecosystem is shifting, and ACA marketing is under increased scrutiny.

With the release of the HHS Notice of Benefit and Payment Parameters for the 2027 Proposed Rule, CMS is signaling tighter oversight of ACA and under-65 marketing. Proposed updates include stricter standards of conduct and clearer prohibited marketing practices, formalized consumer consent documentation, and expanded audit and enforcement authority.

For issuers, brokers, web brokers, and performance marketing organizations, this means one thing: compliance and acquisition infrastructure can no longer operate in silos.

Marketing teams may soon need to prove (quickly and defensibly) what was approved, what went live, what consumers consented to, and how each lead or call moved through the funnel.

Join Phonexa and Aproove for this Amplify Webinar Episode as we explore how structured creative governance and lead-level traceability work together to create audit-ready, scalable ACA marketing operations.

What You’ll Learn:
• What the 2027 Proposed Rule signals for ACA and Exchange marketing oversight
• How evolving consent and documentation requirements impact scripts, forms, and lead generation
• Why “audit-ready” marketing evidence is becoming a business necessity
• How to align creative approval workflows with acquisition tracking and partner governance
• Practical steps to reduce regulatory risk without slowing growth
